PMAN Terms of Service

Effective Date: February 26, 2026 Last Updated: February 26, 2026 These Terms of Service (“Terms”) govern your access to and use of the PMAN software, services, and applications (collectively, the “Service” or “PMAN”) provided by PMAN, LLC (“we,” “us,” “our”). By accessing or using the Service, you agree to be bound by these Terms and all terms incorporated by reference.
1. Acceptance of Terms
By creating an account, accessing, or using PMAN, you agree to these Terms and our Privacy Policy.
If you do not agree, you must not use the Service.
2. Eligibility
You represent that:
  • You are at least 18 years old.
  • You have the legal right and authority to enter these Terms.
  • You are using the Service for business purposes only.
3. Account Registration & Information
You must:
  • Provide accurate, current, and complete information.
  • Maintain and update that information to keep it accurate.
You are responsible for all activity under your account.
4. Free Trial & Subscription
Free Trial
  • PMAN may offer a free trial period (e.g., 30 days).
  • Free trial is limited to one per organization.
  • PMAN reserves the right to modify or cancel free trials at any time.
Paid Subscription
  • After the trial, your account will transition to a paid subscription unless canceled.
  • You agree to pay all fees listed for your subscription plan.
  • Prices may change with notice.
5. Seats & Billing
  • Each active user seat is billed per month at $6.
  • A minimum of one seat must be active each month.
  • Subscriptions are billed monthly in advance.
  • All payments are nonrefundable except as required by law.
6. Use of Service
You agree to use PMAN only for lawful purposes and in compliance with all applicable laws. You are responsible for:
  • Your data and content uploaded to the Service (“Your Content”)
  • Complying with all safety and construction regulations
You agree not to:
  • Interfere with the Service integrity
  • Reverse engineer or attempt to access source code
  • Access the Service for benchmarking or competitive analysis
7. Beta Software
PMAN may include beta features or releases. By using beta features:
  • You acknowledge they may be unstable.
  • You agree they are provided “AS IS.”
  • You agree we have no obligation to continue, support, or release any beta feature.
8. Ownership & Intellectual Property
  • PMAN retains all rights, title, and interest in the Service.
  • All software, trademarks, graphics, and text are the property of PMAN or its licensors.
  • You may not copy, modify, distribute, sell, or lease any part of PMAN.
Your Content remains yours. You grant PMAN a license to use it to provide the Service.
9. Feedback
If you provide feedback, ideas, or suggestions:
  • You grant PMAN a perpetual, worldwide, royalty-free license to use them.
  • You waive any claims to compensation.
10. Privacy & Data Security
Your privacy is governed by our Privacy Policy, which is incorporated here. You understand and agree that PMAN may process, store, and backup data per the policy.
11. Warranties & Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” PMAN MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION:
  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • UPTIME
Construction decisions are the user’s responsibility.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: PMAN’S TOTAL LIABILITY for any and all claims will not exceed the amount you paid to PMAN in the three (3) months preceding the claim. UNDER NO CIRCUMSTANCE SHALL PMAN BE LIABLE FOR:
  • LOSS OF PROFITS
  • LOSS OF DATA
  • CONSEQUENTIAL DAMAGES
  • BUSINESS INTERRUPTION
  • THIRD-PARTY CLAIMS
Even if PMAN was advised of the possibility of such damages.
13. Indemnification
You agree to defend, indemnify and hold PMAN, its officers, agents, partners, and employees harmless from any:
  • Claims
  • Damages
  • Costs
  • Losses arising out of:
  • Your use of the Service
  • Your violation of these Terms
  • Your Content
  • Your violation of any law
14. Termination
PMAN may suspend or terminate your access, without notice, for:
  • Violation of these Terms
  • Non-payment
  • Harmful conduct
  • Legal reasons
You may terminate by canceling your subscription. Sections that survive termination:
  • Intellectual Property
  • Limitations of Liability
  • Indemnification
  • Governing Law
15. Modifications
PMAN may modify these Terms at any time. Changes will be posted with a new effective date. Your continued use after changes means you accept the new Terms.
16. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without conflict of law principles.
Any legal action will be resolved in the courts of Pinellas County, Florida.
17. Arbitration & Dispute Resolution
Except for injunctive relief:
  • All disputes will be resolved by binding arbitration
  • Administered by a reputable arbitration organization
  • In Pinellas County, Florida
Class actions are waived.
18. Notices
Notices will be sent to the email on file.
19. Entire Agreement
This document, together with the Privacy Policy and any referenced agreements, is the entire agreement between you and PMAN.
